Truck Accident Attorneys

A typical tractor-trailer rig or "semi" can weigh as much as 40 tons (80,000 pounds). Passenger cars, on the other hand, typically weigh 2 tons or less and simply are not designed to withstand collisions with such enormous vehicles. When a tractor-trailer and a passenger vehicle collide, the results are usually devastating-particularly for the occupants of the smaller vehicle. For this reason, it is imperative that the driver of a tractor-trailer rig:

  • Be sober, not under the influence of alcohol or drugs

  • Strictly follow the traffic laws

  • Avoid Aggressive tailgating

  • Pay attention to the road, not cell phones

  • Avoid fatigue

  • Understand cargo

  • Properly maintain the vehicle for safety

If you or a loved one has been involved in a wreck with a tractor-trailer or other large commercial vehicle, it is imperative that you immediately retain an attorney to help protect your rights. Evidence will need to be preserved and the scene of the accident will need to be documented almost immediately. Your lawyers can hire experts well versed in trucking accident reconstruction.

Most importantly, do not sign anything or speak to any representatives of the trucking company following an accident. Representatives of the trucking company who are experienced in avoiding liability will use anything you say against you.

Commercial Trucking companies are required to adhere to federal and state laws aimed at protecting the public:

  • Federal Motor Carrier Safety Administrations (FMCSA) laws regulate trucking equipment and hours of operation

  • Federal law mandates that vehicles in interstate commerce shall carry $750,000 of insurance coverage for injury and property damage and many states have their own insurance requirements

  • Trucking companies and drivers are required to maintain logs of activity

  • State Negligence Laws. State tort laws concerning negligence and gross negligence will effect legal proceedings involving trucks, however, regulations about enhanced commercial licensing will also come into play in determining whether a trucking company was negligent
