Slip & Fall

Slip and fall injuries are treated by many as minor personal injury cases or frowned upon because of abusive lawsuits. This is unfortunate because falls can result in truly serious and debilitating injuries. According to the United States CDC, unintentional accidents are the 5th leading cause of death in the country. The National Safety Council has found that falls are the third leading cause of unintentional injury deaths. Falls can also cause severely debilitating injuries.

A fall by itself does not entitle anyone to monetary compensation. However, if the negligence of another person or company is directly responsible for creating a dangerous condition that causes someone to fall and be injured, then the laws do favor plaintiffs.

The duty owed by a landowner can also depend on the status of a potential plaintiff. Business guests or "invitees" are generally owed a higher standard of care than personal guests-"licensees." Trespassers are generally not owed much of any duty. However, where trespassers are foreseeable, they may also be owed a duty of care. For instance, if a landowner creates an "attractive nuisance" on his or her property and has reason to know that children frequent the property, the landowner may be held responsible for preventable injuries to such young trespassers.
