Pedestrian & Bicycle Accidents

Pedestrians and bicyclists are often injured by motor vehicles because the driver was not paying attention, was going too fast, or was intoxicated. The problem is made even worse in cities such as San Diego and Los Angeles where pedestrian traffic and distracted drivers are likely to be found at the same locations, such as near the beach. When a moving 3000-pound vehicle collides with a 150-pound person, serious injuries can result.

California law strongly favors pedestrians and punishing negligent drivers. Pedestrians injured in an accident with a motor vehicle should do the following:

  • Seek prompt medical treatment for all injuries

  • Immediately contact the police and file a report

  • Try to get the identity and contact information of the party driving

  • Do not sign anything or accept any settlement checks without consulting a lawyer

  • Document all injuries with photographs

  • Take photographs of the scene of the accident and save all damaged property, including items such as torn clothes, damaged bicycles, skateboards, etc.

  • Document the scene of the accident and get information from any witnesses who may have seen the accident
